Guarantee


SECTION I: SELLER OBLIGATIONS   

     Our  kennels has made every effort to provide you with a healthy puppy. All of our puppies are cared for and raised indoors with love. We always strive to produce the best of all qualities in our dogs.
     Breeder guarantees that all vaccinations and worming are current. A shot record is included with each puppy. The fact that this puppy has been vaccinated does not guarantee immunity. Puppy must receive a series of vaccinations that are given as recommended by your veterinarian.
     The health of our puppies are our main concern and sometimes delay in shipping may occur due to reasons beyond our control. Our puppies are properly wormed, immunized, and vet checked prior to being placed in their new homes. Puppy will be released or sent to buyer only when seller’s veterinarian gives their approval to do so.
     We ship puppies after 8 weeks of age. A puppy carrier and physical exam and health certificate by a licensed veterinarian are included when a puppy is shipped.
     It is to be understood - the Buyer agrees to provide good care and a loving environment.
You will be responsible to arrange to pick the puppy up upon it’s arrival at the airport. Risk of flying puppies is always a concern for us, so we want to make you the customer a wear of some of the risks involved. These risks are the responsibility of the customer. Your puppy can develop a running nose or develop kennel cough which is very common and can be treated by your veterinarian.

Deposits and Payment.
     A $500 deposit will hold the puppy until time of delivery. Deposits are non-refundable, unless there is a problem with puppy after medical exam. If this puppy for any reason isn’t thriving or dies while still with the breeder, then the breeder will notify you immediately and buyer has the option to pick another puppy, or have deposit refunded.. It is understood that the replacement puppy may not come from the same litter or from the same parents as the original puppy.
     Payment in full is required at the time of delivery.  The balance (including shipping/delivery costs) is due 10 days before the puppy is shipped. After delivery, registration will be signed over to purchaser.

Pedigree.
The puppy you are purchasing is purebred and meets the requirements for registration of the country of origin and can be registered with the American Kennel Club if Buyer chooses to receive pedigree.
This puppy is guaranteed to come with FCI registration papers. We will advise you of the status of a puppy’s registration(s) prior to purchase and we guarantee to provide a registration paper to you for your puppy. The papers for your puppy will be mailed to you as soon as we receive them back from the registry FCI. The Seller is not responsible for delay in processing from the FCI. This process normally takes 60-90 days.
This document represents the final, total, and complete agreement between Buyer and Seller.

Guarantee.
     All items covered under this guarantee are by replacement only. We do not give refunds. We not responsible for any medical expenses incurred, or any shipping costs. Buyer is aware that owning a puppy/dog means regular veterinary care and understands that they will be responsible for all payments.
     Our commitment is to provide the utmost care for our puppies. We help ensure that our customers will be receiving sound, healthy puppies. It should be noted, however that the buyer understands that due to the nature of the Breed, French Bulldogs are predisposed to conditions during his/her lifetime. The Buyer is urged to research the Breed and be familiar with all the different health issues that could affect their French Bulldog.
     Bulldogs are susceptible to many conditions that are not covered on this guarantee such as but not limited to (internal, external parasites, elongated soft palate common to the breed, cherry eye(s) this condition is caused by bullies having a third eyelid, entropion, allergies, stenotic nares (pinched nostrils), loose knee joints this normally correct itself as the puppy grows, plays and strengthens the ligaments and muscles, inguinal or umbilical chord hernias,  demodex mange, and hip dysphasia)  Due to the structure and formation of bulldogs the above conditions are not covered under this guarantee.
There are a few reasons that we exclude hips from our coverage.
1) Because of the angularity and frame structure of Bulldogs, a person could make the case that every bulldog (in theory) is displastic to a degree.  Much of what could be clinically classified as displasia via X-ray, has no negative impact on the dog in terms of discomfort or physical limitations and is a result of breed characteristics that are specified in breed standards.
2) There are factors other than genetics that contribute to Displasia. Including, but not limited to, the slope that a dogs lives on, the floor surface, the activities the dog participates in.

     The Seller guarantees this French Bulldog, as previously stated, to be free of life-threatening genetic conditions, and that if any such condition has been found and proven, in writing by a licensed Veterinarian and substantiated by x-rays and or by lab tests and is confirmed by the Sellers Veterinarian.
     It is the buyer's responsibility to take this puppy to their veterinarian within 48 hours of possession, for examination. If this occurs on a weekend or holiday, an extra 24 hours will be granted.  If the puppy is found to have a life threatening congenital defect or health problem at the time of this exam, breeder must be contacted and a  a copy of report must be faxed to our veterinarian within 48 hours.  Upon veterinary consult and agreement, a replacement puppy of same quality will be given as soon as available.  
     Puppy must be returned, at buyer's expense, along with all registration papers and documents that came with the puppy at time of purchase.  The Buyer is responsible for all vet bills, and transportation costs incurred prior to the return of such French Bulldog as stated.
     It is the seller's prerogative, in some instances, to offer cash compensation instead of  a  replacement puppy.  In those instances the compensation amount is determined by subtracting what the buyer paid for the puppy minus  the fair market value of the puppy as a result of the genetic defect.
     Seller will consider a replacement puppy only if the conditions detailed in the above section are met. If the puppy has not visited the veterinarian as agreed within the 48 hour time frame, and Seller, immediately following exam, has not received the Veterinarian Examination Report, NO exchange or refund will be considered.
     To return a puppy, notify us by e-mail prior to return. Buyer will be given a replacement puppy of comparable size and value. (If replacement puppy is not available at this time, Buyer will be given a choice for a voucher for a puppy and notified immediately when comparable puppy is available.

     This guarantee does not include uneven bites, undescended testicles. A diagnosis of coccidiosis, giarrdia or any other type of bacterial infection does not render your puppy unhealthy.  Coccidia and Kennel Cough, which is common in puppies that are shipped and usually caused by bacteria. Kennel Cough is self-limiting and like the common cold, it must run its course. Full recovery is expected and Kennel Cough on its own is not life threatening. Any physical problem that is or could be the result of injury is not covered by this guarantee.

Parvo virus.
We offer a cash compensation, not replacement, in the instance of  a puppy we sell that acquires the Parvo virus.
     Parvo is a canine virus that has an incubation period of 3-7 days.  If the puppy breaks with Parvo within the first three days after you receive it, then it probably did not contract the virus at your location and we will compensate up to $350 in documented medical expenses related to Parvo if it is reported to us within 72 hours after the puppy is received.  
If the puppy breaks with Parvo between three days and seven days, then it is less clear whether the puppy contracted the virus at your location or otherwise.  We will compensate $175 for documented medical expenses related to Parvo that are reported to us three to seven days after the puppy is received.  
We will not make any compensation for parvo that is reported to us seven or more days after the puppy has been received.

Breeder further guarantees this puppy for 6 months (from the date of birth).
     Breeder further guarantees this puppy for 6 months (from the date of birth) against congenital defects that are life threatening or that would severely diminish the quality of the life of the puppy. Should the puppy be diagnosed before 6 months (from the date of birth) of age of any congenital/hereditary disorder which is considered by two unassociated veterinarians to seriously impact the quality of life, short of euthanasia, or require continuous medical treatment daily throughout the course of the puppies life and makes this puppy unsuitable for a pet, we will upon provision of veterinary reports, provide Buyer with one of the following Options:
1) Should buyer choose to keep the puppy and accept partial refund, we will, upon receipt of Proof of Spay/Neuter (if puppy is of age to have had spay/neuter performed) & return of AKC/Other Reg. Papers, refund 50% of purchase price. Transportation expensed incurred by the buyer will NOT be kennel responsibility.
 OR  
2) Should buyer choose to relinquish ownership of the puppy to kennel, we will replace the puppy, less any Shipping or Miscellaneous charges necessary for transportation of puppy to/from this location. FCI/AKC/Other Reg. Papers (when received by buyer) with a signed transfer of ownership back to the seller must accompany the puppy. The puppy must be in good condition at the time of return and must not have any other illnesses or debilitating conditions other than the genetic defect that it is being returned for. Breeder will replace this puppy with another of the same breed, quality and sex. The replacement will be subject to availability (within approximately 8 months). The puppy will be replaced, no moneys will be refunded.
Veterinarian expensed incurred by the buyer, for any reason, will NOT be kennel responsibility.

     A puppy with a defect can be euthanized with the prior permission of the Seller. No replacement puppy will be given if the puppy has been bred, spayed, neutered, or euthanized without Seller"s permission.

     Breeder will not be responsible for illness or health problems, which are diagnosed after this time period.
     If for any reason, under any circumstance, a replacement puppy is offered and you decline it, this contract shall be considered completed and fulfilled. There will not be another puppy offered to you and you understand and agree that any money already paid to the breeder will be forfeited, as there are no refunds.
     Breed related, correctable/treatable, minor conditions or any condition that the puppy will more than likely outgrow, or that can be treated by a licensed Veterinarian, are not covered by this guarantee.

In the unlikely event of puppy's death in the first 6 months.
     In the unlikely event of puppy's death in the first 6 months, Buyer will take the deceased puppy to a veterinarian of his choice for the purpose of an autopsy at BUYER'S expense.
A statement from a veterinarian confirming such an event and cause is required before the Breeder will take any action. Breeder must be contacted and a  a copy of report must be faxed to our veterinarian within 48 hours. Assuming the two veterinarians agree the puppy died of natural causes of a warrantable condition, if reason is congenital, a replacement puppy of same quality will be given as soon as available. Under no circumstances will the Breeder be responsible for veterinary or medical bills incurred. Transportation expenses involved in the shipping of the replacement puppy are the responsibility of the buyer.
     However, if trauma or neglect is found to play a role in the demise of the puppy in any manner or fashion, then no exchange will be forthcoming.  Additionally, Buyer agrees to hold Seller harmless for such.

Additionally.
 No guarantee is made as to disposition, conformation. No guarantee is made regarding temperament or size. We offer no compensation for circumstances or characteristics that limit the dogs ability to be bred or competitively shown. Puppy is purchased as having show potential. There is no guarantee that his puppy will win in conformation classes, or ever become a champion. You must show this puppy a minimum of ten times to give it a fair chance at competition.


SECTION II:  BUYERS OBLIGATIONS   

     The buyer agrees to care for dog as would a humane and conscientious dog owner and agrees to provide:
1.) Proper veterinary care is given immediately, including but not limited to injuries, illness, and annual checkups, keeping all immunizations current according to the American Veterinary Medical Association Guidelines and kept on heartworm preventative as per veterinarian instructions.
2.) Adequate housing for this dog within the Buyers home and yard.
3.) Adequate exercise by providing the dog with supervised walking and running on a regular basis.
4.) Feed the dog a good quality pet food. Instructions for feeding given by the breeder.
5.) All expenses regarding the animal including: shipping the animal, proper care, veterinary fees, housing or legal liabilities are the responsibility of the Buyer at whose home the animal will reside.
6.) The buyer agrees to inform kennel of any titles or awards obtained by the animal for our breeding records.

     This a guarantee is valid for original purchaser that purchased the dog kennel. If the dog is transferred to another owner this guarantee is null and void.
